Filing a Takedown Notice
If you believe that content on FarmHub infringes your copyright, you may submit a written notification to our Designated Agent. Your notice must include all of the following:
- A physical or electronic signature of the copyright owner (or a person authorized to act on their behalf).
- Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, provide a representative list.
- Identification of the material that is claimed to be infringing, including sufficient information for us to locate it on the Platform (such as the URL of the page where the material appears).
- Your contact information: name, address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
Counter-Notification
If you believe that your content was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Designated Agent. Your counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled and the location where the material appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Polk County, Iowa if outside the United States), and that you will accept service of process from the person who provided the original takedown notification.
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.
Good Faith Requirement
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing (or that it was removed by mistake) may be subject to liability for damages, including costs and attorney fees.
Repeat Infringers
FarmHub will terminate the accounts of users who are found to be repeat copyright infringers, in appropriate circumstances and at our sole discretion.
